According to a report published by the National Foundation for American Policy (NFAP), Indians will now have to wait for 179 years to obtain a green card. This wait relates to the employment-based second preference (EB-2) category. The excessive wait time is caused by a massive immigration backlog and high demand.
Why will Indians have to wait 179 years for a Green Card?
To sum up, the culprit remains immigration backlog. In the 1990s, the United States Congress capped employment-based green cards at 140,000. This limit includes highly skilled workers as well as their dependents.
Moreover, no country is to receive more than 7% of the total number of green cards each year. These caps are intended to ensure diversity, and are consistent with the “America First” rhetoric. Therefore, a densely populated country like India is severely restricted compared to relatively less populous nations like Iceland or Luxembourg. As a result, Indians will now have to wait 179 years in the immigration bottleneck.
How is the 179-year wait calculated?
NFAP based these calculations on historical data. In the past three years, 264,521 people applied for EB-2 status. However, only 12,262 were approved and received green cards. This means that each year, more than 90% of Indian applicants and their dependents form part of the existing backlog.
The current backlog of nearly 1 million Indians would take approximately 179 years to clear and for each applicant to be granted a green card. This reveals practical impossibility of navigating the current. Moreover, children who entered the United States as dependents will eventually turn 21 and lose their “dependent” status. They will be forced to leave the country or struggle to obtain temporary work visas.
The situation seems dire for Indians as the number of “documented dreamers” increases. The term refers to Indians dependents who age out of the system. Despite spending their entire lives in the country, they are treated as foreign nationals the moment they graduate from college.
Implications of the massive waiting times
Workers on the H-1B visas in the queue for a green card have limited opportunities. They have to pay hefty taxes but cannot change jobs at will, start businesses or travel with ease. In case workers are laid off, they only have a 60-day grace period to find a new employer who is willing to sponsor their visa.
Frustrated by the lengthy and exhausting procedural hurdles, Indian talent has sought opportunities in other countries. Many have sought residency in Canada, Germany, and the UK. Notably, Canada’s H-1B open work permit policy has lured tech workers from Silicon Valley to Toronto.
Moreover, many Indians are looking for ways to bypass the EB-2 category by ditching the corporate ladder. There has been a rise in alternative options such as EB-5 investor visa and EB-1A (Extraordinary Ability) visas.
There has also been a rapidly increasing trend of “reverse migration”. Indians, instead of waiting for years in restrictive conditions, are returning back to India. This is contributing to the growth of India’s domestic SaaS, fintech and AI ecosystems.
