A German court on Wednesday said that emitters could be held responsible for the costs caused by their carbon emissions in a ruling from a case brought by a Peruvian farmer against German energy giant RWE.
“If there is a threat of harm, the polluter of CO2 emissions may be obligated to take preventive measures… (or) bear the costs in proportion to their share of the emissions,” the higher regional court in Hamm said, although it rejected the farmer’s specific claim.
